1. Product Description & Intended Use

Products sold by Bergsonne Labs are electronic development modules designed and intended solely for use by qualified engineers, developers, and electronics professionals for the purposes of evaluation, prototyping, experimentation, education, and integration into other electronic designs. Products are sold as electronic subassemblies and components, not as finished consumer products.

2. Regulatory Compliance

Unless explicitly stated on an individual product listing, Products have not been tested for or certified under FCC Part 15, UL, CE, RoHS, or other regulatory standards. Products may generate, use, or radiate radio frequency energy and have not been tested for compliance with the emissions limits for consumer devices.

When incorporated into a finished product, the manufacturer of that finished product is solely responsible for obtaining all necessary regulatory certifications and authorizations — including but not limited to FCC equipment authorization, CE marking, and UL listing — prior to marketing or sale of the finished product.

3. Restricted Applications

Products are not designed, tested, authorized, or warranted to be suitable for use in:

• life-support devices or systems;
• surgical implantation or other medical devices;
• nuclear facilities or systems;
• aerospace or aviation systems;
• automotive safety systems;
• military or weapons systems; or
• any other application where product failure could reasonably be expected to result in personal injury, death, or significant property or environmental damage.

Use of Products in any restricted application is strictly prohibited. If Buyer uses or sells Products for any restricted application, Buyer acknowledges that such use is at Buyer’s sole risk, and Buyer agrees to indemnify, defend, and hold Bergsonne Labs harmless from and against any and all claims, damages, losses, costs, expenses, and liabilities arising out of or in connection with such use.

4. Pricing & Payment

All prices are listed in US Dollars (USD) and are exclusive of applicable taxes, shipping, and duties. We reserve the right to change prices at any time without prior notice. Volume discounts are applied automatically at checkout based on the quantity of each individual line item: 10% off at 10 or more units, and 15% off at 50 or more units.

Payment is processed at the time of order through our third-party payment provider (Stripe). We do not store credit card information on our servers.

5. Shipping & Delivery

Delivery times are estimates only and are not guaranteed. Bergsonne Labs is not liable for delays caused by carriers, customs, or events outside our control. Risk of loss passes to Buyer upon delivery to the carrier.

6. Preorders

Certain Products may be available for preorder when current stock is depleted but future stock is expected. The estimated availability date shown is an approximation and is not guaranteed. Preorders are charged at the time of order. If we are unable to fulfill a preorder within a reasonable timeframe, we will notify you and offer a full refund.

7. Returns & Refunds

Due to the nature of electronic components, Products that have been soldered, modified, or integrated into another design are not eligible for return. Unused Products in their original condition may be returned within 30 days of receipt for a refund, less shipping costs. Defective Products will be replaced or refunded at our discretion. Please contact us to initiate a return.

8. Disclaimer of Warranties

Products are provided “as is” and “as available.” Bergsonne Labs disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Bergsonne Labs does not warrant that Products will meet Buyer’s requirements, operate without interruption, or be error-free.

9. Limitation of Liability

In no event shall Bergsonne Labs be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with Products, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. Bergsonne Labs’ total aggregate liability shall not exceed the purchase price paid by Buyer for the specific Product giving rise to the claim.

10. Intellectual Property

Purchase of Products does not convey any license, express or implied, under any intellectual property rights of Bergsonne Labs, except for the right to use the Products as electronic components in Buyer’s own designs. Product documentation, schematics, and design files remain the property of Bergsonne Labs unless otherwise stated.

11. Safety

Your safety is your own responsibility. Products involve electronic components that may pose risks including electrical shock, burns, and fire if improperly handled. Buyer assumes all risk associated with the use of Products and is responsible for ensuring proper handling, adequate safety precautions, and compliance with all applicable laws and regulations. Products are not intended for use by children.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued purchase of Products after changes are posted constitutes acceptance of the revised Terms.
